Ungovernable Juvenile

IC 31-37-2-4 - Delinquent act; habitual disobedience of parent, guardian, or custodian

Sec. 4. A child commits a delinquent act if, before becoming eighteen (18) years of age, the child habitually disobeys the reasonable and lawful commands of the child's parent, guardian, or custodian.

What can you do?

Parent and guardians can provide the probation department with information about their child's willingness to obey the reasonable rules and commands of their household by completing an Ungovernable Child Complaint Form (This form is also available at the Juvenile Probation Department). It is important to note that this form is not meant to take the place of a police report if your child is committing acts that could be considered criminal in nature. If your child is committing acts which could be considered criminal in nature, please report such information to the appropriate law enforcement agency.

Please be aware that this department is limited as to options it has on an ungovernable complaint. Completing the form will not remove any of your responsibilities or rights as a parent. In most cases a formal petition will not be filed.

Indiana law prohibits detaining a child for ungovernable behavior. You should also understand that completing this form will not be cause for removal of your child from your home and placement of that child into an institution.
